Agreement to Terms

These Terms of Service ("Terms") govern your use of the Electrician Pro X mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

Electrician Pro X is a mobile application designed for electrical contractors and professionals. The App provides tools for:

• NEC (National Electrical Code) calculations and references
• Job management and tracking
• Creating and sending estimates
• Creating and sending invoices
• Time tracking
• Business analytics

Account Registration

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

Subscription and Payments

Free and Premium Features

The App offers both free features and premium features available through a paid subscription.

Subscription Terms

• Subscriptions are billed monthly at $12.99 USD (or current pricing as displayed in the App)
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription through your device's account settings

Free Trial

• We may offer a free trial period for new subscribers
• If you do not cancel before the trial ends, you will be automatically charged for the subscription
• Free trials are limited to one per Apple ID or Google account

Refunds

Refund requests are handled by Apple (for iOS) or Google (for Android) according to their respective refund policies. We do not process refunds directly.

Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Upload viruses or malicious code
• Use the App to send spam or unsolicited communications
• Impersonate any person or entity
• Use the App in any way that could damage, disable, or impair the service
• Reverse engineer, decompile, or disassemble the App

Your Content

Ownership

You retain ownership of all data, content, and information you enter into the App ("Your Content"), including job information, client data, estimates, invoices, and photos.

License to Us

By using the App, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the App's services to you.

Responsibility

You are solely responsible for Your Content and ensuring you have the right to enter and use any client information, photos, or other data you input into the App.

"As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The results from using the App will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ELECTRICIAN PRO X OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Electrician Pro X and its operators from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.

Intellectual Property

The App and its original content, features, and functionality are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent.

Third-Party Services

The App uses third-party services including Firebase, Resend, RevenueCat, and Apple/Google payment services. Your use of these services is subject to their respective terms and privacy policies.

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and data
• Provisions that by their nature should survive termination will survive (including ownership, warranty disclaimers, indemnity, and limitations of liability)

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or sending you an email. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
